Role: Legal Counsel – Lending (Fixed Term Contract – 12 months)

What does the legal team do?

The team consists of qualified lawyers who  support two growing client segments in the Bank:

Specialist Lending - Real Estate (“RE”)

The Real Estate business aims to assist established property entrepreneurs and businesses, both HNW and mid-sized corporates/funds, in wealth creation through their property activities. It provides senior debt development and investment funding solutions across the residential, commercial, mixed-use and student accommodation sectors. The business also co-invests with equity in certain value add propositions.

HNW/Private Clients (“HNW/PC”)

With clients being at the centre of our business offering, the HNW/Private Clients segment provides a range of flexible and bespoke facilities tailored to meet the needs of our clients. This distinctive offering is grouped into the following:

High Net Worth Offering – a range of transactional banking, savings, mortgage and specialist loan products and services designed to meet the needs of high net worth clients.

High Income Offering – a range of transactional banking, savings, mortgage and loan products and services designed to meet the needs of high income professionals.

What is the role?

As part of the team you will be primarily responsible for providing technical expertise and support in the area of law and regulation affecting the HNW/PC client segment though you will also be expected to support the RE business as and when required.

The role will specifically involve mitigating all legal risk and ensuring that all legal systems and protections are satisfactorily in place at all times. In addition, the role will be integral to ensuring that the high standards, quality of work and speedy turnaround time of the Team is maintained during the forthcoming expansion of the both businesses. This will result in a significant increase in the volume of work for the Team and the successful candidate with play a crucial role in assisting with the management and execution of this increased workload.   

What are the main responsibilities?:

  • Providing expert and timely advice particularly in relation to law and regulation relating to lending, security, banking and financial services issues, primarily in the HNW/Private Clients area together with some work for the Real Estate business.
  • Participating in the development of processes, policies and procedures designed to mitigate legal risk and/or increase the efficiency of the team;
  • Managing the provision of external legal support to including ensuring that external advisers are duly and appropriately appointed;
  • Liaising with the Co-leads of RE&HNW/PC Lending Legal, the wider Legal community and other stakeholders throughout Lending on legal risk matters affecting the lending environment;
  • Implementing  appropriate segregation of duties so that legal documentation is reviewed and executed with the appropriate level of independence from the persons involved in proposing or promoting the transaction;
  • Liaising with the credit / investment decision and analysis forums and credit / investment monitoring and reporting teams to ensure that all transactions are executed within the relevant credit / investment authority; 

What core skills and knowledge do we need?

  • Real Estate or Real Estate finance solicitor with 1-3 years' PQE, with experience having been gained in-house within financial services or at a highly reputable law firm;
  • Banking & Finance/Secured Lending experience also desirable;
  • Knowledge of MCOB regulated lending and non-regulated lending and/or consumer credit law would be helpful but not essential;
  • A willingness to take on unfamiliar tasks and be able to work through them to a satisfactory conclusion;
  • A practical approach and the ability to make clear and concise decisions as well as using initiative as and when required
