Solicitor – Asset Finance (3830)

Role: Solicitor – Asset Finance

Location: Agnostic

Can be part time 3-4 days a week or Full time 

Overview of Asset Finance Group:

AFG provides asset finance across a broad spectrum of asset classes and market sectors to SMEs, corporates, professional practices and individuals; together with loans, invoice finance, motor finance, wholesale funding and insurance premium finance. Deals are typically introduced via a panel of specialist brokers, with some direct to customer and consumer credit regulated business. 

What are the key responsibilities?

  1. Deliver legal support and advice in respect of AFG activities generally across multiple offices in the UK and Channel Islands, including but not limited to all CCA and FCA regulatory requirements.
  2. Provide effective legal advice/oversight and support in relation to:
  • Transaction documentation such as HP, PCP, lease and loan financing agreements, security documents, novations etc;
  • Back book related matters including regulatory advice, problematic complaints and litigation;
  • New products;
  • Policies and procedures;
  • Legal documentation including NDAs, terms and conditions and client documentation (including consideration of unfair contract terms/matters);
  • Effective management information for stakeholders.

        3. Oversee the negotiation and preparation of contractual documentation with the business and with external lawyers, where instructed.

        4. Identify legal risks in consideration of internal credit requirements.

        5. Assist in various capacities with the delivery of AFG transactions and projects, special initiatives, new products, issues resolution or business opportunities.

        6. Liaise with Compliance to ensure adherence to IBP's regulatory obligations and implementation of new initiatives.

        7. Review and oversee external legal providers to AFG to ensure compliance with service level agreements and IBP legal policies, and manage records of external   invoices.

        8. Ensure the AFG platforms (e.g. contractual templates) have a robust legal risk environment, review new documentation (including third party intermediary contract templates) and maintain accurate records.

        9. Arrange for registration of charges with Companies House and maintain records or all such correspondence/documentation

        10. Other ad hoc support for AFG as the case may be from time to time.

What core skills and knowledge do we need?

  1. Technical Competence as applicable to role: Knowledge of asset finance, FCA regulation, CCA, data protection, Financial Ombudsman Service requirements, trading standards, contract law, and working knowledge and experience in banking documentation.
  2. Relationship Management and communication: Ability to create and maintain strong relationships with key interfaces, especially external lawyers, front office and team members.
  3. Risk Understanding: Ability to assess and interpret legal risks.
  4. Knowledge of regulatory framework: Knowledge of the regulatory requirements within a regulated business.
  5. Investec Specific Knowledge: Knowledge of Investec procedures and compliance protocols.
  6. Regulatory Knowledge as applicable to role with experience in financial services (compulsory)
  7. To act with integrity at all times and embrace the philosophy of treating our customers fairly (compulsory)
